Javorsky v. Flock Group: California class action over plate-data sharing

verifiedchecked v3.7

Filed by named plaintiffs Daniel Javorsky and Anthony Mayor in San Francisco Superior Court, dated February 26, 2026. Removed to federal court as No. 4:26-cv-02382-HSG (N.D. Cal.). Initially before Magistrate Judge Laurel Beeler on consent; reassigned March 23, 2026 to Judge Haywood S. Gilliam, Jr.; related to the consolidated case and reassigned to Judge Vince Chhabria on May 8, 2026; consolidated May 29, 2026 with Eldridge v. Flock and Dutcher v. Flock into In re Flock Group Inc. Automated License Plate Reader Litigation, No. 3:26-cv-02375 (N.D. Cal.).

Five causes of action: the California ALPR Privacy Act (Cal. Civ. Code §§ 1798.90.5 et seq.); negligence; invasion of privacy under the California Constitution; intrusion upon seclusion; and the Unfair Competition Law (Cal. Bus. & Prof. Code §§ 17200 et seq.). Damages sought: actual damages or not less than $2,500 in liquidated damages, plus punitive damages.

SFPD's database was queried by out-of-state and federal agencies more than 1.6 million times between Aug 2024 and a later cutoff. California ALPR data allegedly reached over 300 out-of-state law enforcement agencies, including 287(g) program participants. Flock's own marketing claims 20+ billion plate reads per month nationwide (Flock's self-description). Mountain View and Los Altos are cited as cities whose anti-sharing configurations Flock allegedly overrode.
